Both Queensland and Commonwealth legislation require that a course must first be registered on CRICOS before a provider promotes, makes an offer to, or enrols a student who holds a student visa (maximum penalty 2 years imprisonment ESOS Act 2000).
Only courses which require an overseas student to attend full time study for a minimum of 20 hours per week can be registered. The duration of a course should be longer than 12 weeks. Overseas students are able to attend courses of shorter duration on a visitor's visa.
Applications to register a new course must be submitted to the State Authority for approval. Approval can only be granted if the course meets all of the requirements for course registration under the Queensland legislation, the ESOS Act 2000 and the National Code. A checklist (new window) 135k

In order to facilitate the approval and registration process, it is important that ALL sections of the application form are completed in full and any necessary documentation provided to verify details supplied on the form. Incomplete forms will be returned to the provider.
The course registration process takes approximately four (4) to six (6) weeks. Providers will be notified of the outcome of their applications for new course registration.
