Following approval by the State Authority, providers must also meet the criteria for CRICOS registration specified in the Education Services for Overseas Students Act 2000 and Regulation 2001. The State Authority is also responsible for ensuring a potential provider is able to comply with the requirements of the National Code before granting approval for registration. CRICOS Approval
Arrangements, or changes to arrangements with other providers for the delivery of a CRICOS registered course in Queensland must be approved by the designated authority (Office of Non-State Education CRICOS Unit) prior to institutions implementing those arrangements (NC10.4).
The designated authority will determine which provider is appropriate to be registered for the course, or whether it is considered that two arrangements and two courses should be registered on CRICOS. The provider 's suitability for registration will be assessed in light of its connection with and responsibility for the course (e.g. where one develops the curriculum and awards the qualification, and another delivers the tuition). It should be noted that CRICOS registration for courses is not transferable between providers.
Application for approval of arrangements must address the criteria on the CRICOS Guidelines for -Arrangements with other Providers (new window) 27k
and include all providers to be involved in providing a registered course and the role played by each provider in the delivery of the course. The application should also indicate the single provider recommended to be registered for the course.

Legislative Responsibilities
The registered provider is responsible for meeting legislative obligations and for any breaches of the ESOS Act 2000, National Code 2007 or Queensland Education (Overseas Students) Act 1996 and Education (Overseas Students) Regulations 1998. This is regardless of whether it is the registered provider or the provider with whom it has an arrangement who is responsible for that activity.

Applications for new registration should be accompanied by the registration fee of $245.00. The fee for renewing registration is also $245.00.
