SCM-PR-006: Hostile People on School Premises, Wilful Disturbance and Trespass

Dealing with people visiting school facilities whose behaviour, in the opinion of the principal, is unacceptable in that it threatens the provision of a safe school environment for staff, students and visitors, or who do not have lawful authority to be on school premises.

Statement of intent

The Department of Education and Training (the Department) is committed to taking all reasonable steps to provide a safe school environment for staff, volunteers, students, parents and visitors.

The word "school" is used to describe all State educational institutions including State primary, secondary and special education schools, State environmental education centres and outdoor education centres.

It is an offence for a person to wilfully disturb the good order or management of a State educational institution (s.333(1)).

It is also and offence to insult (meaning "to treat insolently or with contemptuous rudeness, to abuse") an officer of a State educational institution in the presence or hearing of a student of the institution who is in or about the school premises, or assembled with others for educational purposes at, or in, any place (s.333(2)) of the Act.

Further, it is an offence for a person to be on the premises of a State educational institution unless the person has lawful authority or a reasonable excuse for being on the premises (s.334 of the Act).

While the Act provides certain remedies for unacceptable behaviour, schools and their communities may consider developing a Code of Conduct or standards that apply to people accessing schools. These could be developed as part of the overall school behaviour management plan and provide a guide to acceptable behaviour at the school.

The directions/orders that may be issued under the Act to persons whose conduct on school premises is unacceptable cannot be made in respect of exempt persons. Exempt persons are different for each section, but may include students of the school, or employees of the Department engaged to perform work at the school (the term "employees" includes a contractor or subcontractor for the Department or an employee of the contractor or subcontractor).

In respect of directions/orders made under ss.352 and 353 of the Act, and the offences in s.333, the only exempt persons are students.

A number of checks and balances have been included in the provisions of the Act that will minimise the opportunities for misapplication of the powers. These include:

The Act's provisions apply only to conduct or behaviour that takes place on school premises. It does not matter whether the premises have buildings on them or not, or whether the conduct occurs in school hours.
